Hardware Sales Terms
These terms apply to every GB10 machine bought in GPUwerk's store. The cloud Terms of Service cover your GPUwerk account and rentals, not the purchase itself. If you choose to have a machine hosted by GPUwerk or set up for self-hosting (section 7), the partner terms you accept at that point also apply to it. The version of these terms in force when you pay applies to your order.
1. Seller and contact
The seller is PRINT IT! SE, trading as GPUwerk, Altajská 1568/2, Vršovice, 100 00 Praha 10, Czech Republic, IČO 069 60 090, DIČ CZ06960090. Contact [email protected] about orders, cancellation, withdrawal, returns or claims. Further company details are in our Imprint.
2. Machines and prices
Each machine is identified by maker, model, storage and the maker's part number. Prices are per machine and exclude VAT. Euro, Czech koruna and US dollar prices are set by GPUwerk; prices in Polish złoty, Hungarian forint, Romanian leu, Swedish krona and Danish krone are derived from the euro price at the Czech National Bank's rate of the day and rounded. VAT, shipping and transit insurance are added in the checkout and shown before you pay.
Prices can change at any time. Machines that GPUwerk buys from other distributors and shops for your order (section 3) are priced from those suppliers' current prices and can change several times a day. The price shown in the checkout when you place your order is the price you pay, and your order keeps it.
3. Where the machines come from, and when
The Lenovo ThinkStation PGX comes from GPUwerk's own batch; the store shows the date that batch is expected at GPUwerk. Other makers' machines are bought for each order from distributors and shops in Czechia and the EU, and the store shows an estimate, as a range of working days, of when the machine can be at GPUwerk. A "longer delivery" offer is the same machine from a slower source at a lower price. Supplier stock is indicative and is not reserved by adding a machine to the cart. Delivery dates are estimates; GPUwerk tells you by email if one moves.
4. Ordering and payment
You order in the checkout with your billing details and delivery address. You pay the full price in advance, either by card through Stripe, charged when you place the order, or by bank transfer to the account and with the variable symbol shown; for a bank transfer GPUwerk holds the machines for 2 days, after which an unpaid order lapses. Placing an order and paying for it is your offer to buy. The contract is concluded only when GPUwerk confirms your order by email, after it has confirmed the supply of every machine in it: for a machine from GPUwerk's own batch, in the email that confirms your payment; for a machine GPUwerk buys from a supplier, once the supplier has accepted GPUwerk's purchase order, normally within 2 working days. If GPUwerk does not confirm your order, it cancels it and refunds your payment in full. Your payment is an advance: you receive an advance tax document for it (or, where no VAT is due, a payment confirmation), and the final tax document when the machine is supplied.
5. Delivery
GPUwerk ships each machine from Czechia once it has reached GPUwerk and been checked: by PPL within Czechia and by DHL Express elsewhere, door to door, and emails you the tracking number. Shipping and transit insurance (1% of the machine's price excluding VAT, at least CZK 300) are charged per machine at the prices on the shipping and delivery page. Destinations marked "quote on request" cannot be ordered online. GPUwerk does not sell to buyers in, or ship to, countries under EU or US sanctions. For a delivery outside the EU, GPUwerk makes the export declaration; import duties and taxes in the destination country are yours.
The machine is supplied, and becomes yours, when GPUwerk hands it to the carrier for your address. If you buy as a consumer, the risk of loss or damage passes to you when you receive it. The transit insurance covers the machine on its way; tell us promptly if a parcel arrives damaged.
6. VAT
Czech VAT at 21% applies, except that: a business shipping to another EU member state with a VAT ID of a member state other than Czechia, confirmed by the EU's VIES system, buys without VAT under the reverse charge, and the machine is shipped only once VIES confirms the VAT ID again at dispatch; a buyer whose delivery address and billing country are both outside the EU buys without VAT as an export. Private buyers in other EU member states pay Czech VAT while GPUwerk's sales to them stay under the EU's EUR 10,000 distance-selling threshold; beyond it, delivery to them may not be offered. The checkout shows the VAT treatment of your order before you pay.
7. Hosting by GPUwerk or self-hosting
After paying, and until your machine's batch reaches GPUwerk, you may choose for each machine:
- Host at GPUwerk. The machine is not shipped: GPUwerk assigns a specific machine to you by serial number in its Czech datacenter, which is when it is supplied and becomes yours, and houses it for €29 per month excluding VAT. GPUwerk rents it out on equal terms with its own machines and pays you 70% of what renters pay. No rented hours or income are promised. The shipping and insurance you paid are refunded, together with a hosting rebate of up to 4% of the machine's price excluding VAT (for a machine bought from a supplier, no more than keeps its price above GPUwerk's cost), and the VAT is recalculated for a machine that stays in Czechia: Czech VAT at 21%, or the reverse charge for a business with a VIES-confirmed VAT ID in another member state that declares the machine is intended to be sent to it later. This choice is final. GPUwerk sends the machine to you later on request, at the shipping prices then published.
- Self-host. The machine is shipped as ordered, prepared by GPUwerk so that it joins your GPUwerk Platform account on first start and can be rented out from your premises. You may switch back to plain shipping until GPUwerk has prepared it.
Both choices are made under the partner terms shown and accepted in your account. If you make no choice, the machine is shipped as ordered.
8. Cancellation and late delivery
Until a machine is shipped or assigned to you, GPUwerk may cancel your order, or the affected machines, before or after confirming it, when its supply changes: for example when a supplier cannot deliver the machine or withdraws its offer, when the supplier's price rises above the price you paid, when the delivery date can no longer be met, or when the machine becomes unavailable in GPUwerk's supply chain for another reason. GPUwerk tells you by email and refunds what you paid for the cancelled machines in full, using your original payment method, within 14 days. Your mandatory rights as a consumer remain unaffected. If a machine has been neither shipped nor assigned to you within 30 days after the date or estimate shown when you ordered, you may cancel it by email and receive a full refund for it.
9. Consumer withdrawal and returns
If you buy as a consumer, you may withdraw from a distance purchase of goods without giving a reason within 14 days after receiving the goods. For a machine hosted by GPUwerk, which you do not receive, the 14 days run from the day GPUwerk assigns it to you, and withdrawing also ends its hosting. Tell us clearly at [email protected] or by post to the seller address above; you may use the model text below. We give you return instructions. You bear the direct cost of returning the goods. We refund the payment, including the shipping and insurance you paid, using the original payment method within 14 days of your notice. We may wait until we receive the goods or evidence that you sent them back. Mandatory rights in your country of residence remain unaffected.
Model withdrawal notice: “I hereby withdraw from my contract for the purchase of [product and order number], ordered on [date], received on [date]. My name and address are [details]. Date: [date].” Email this text to [email protected]. A signature is needed only for a paper notice.
10. Faults and statutory guarantee
Consumers keep the statutory legal guarantee for goods, including at least two years' protection for goods that are faulty or not as described, counted from receipt (for a hosted machine, from assignment). Contact [email protected] with your order number and the problem. Manufacturer warranties are additional and do not replace your statutory rights. A business buyer's remedies follow the applicable law.
11. Personal data and disputes
We use order and delivery details to process the purchase, payment, shipment and support; see our Privacy Policy. Czech law governs, without limiting mandatory consumer protection or jurisdiction in your country of residence. Please contact us first if you have a problem. A consumer may also refer a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, adr.coi.cz) for out-of-court resolution; this does not limit any formal remedies.
